This is a travel web site, promoting goods and services supplied by ODS and various third parties in the tourism sector, amongst which are hotels, tour operators (organising guarenteed departure tours), publishers of travel books, independent official tour guides and similar tourism entities offering travel related services. ODS solely assists customers in determining the availability of travel-related goods and services and makes legitimate reservations.

User shall also agree to pay all duties, taxes, and related charges arising out of its use of this or any other site owned by ODS and of the services provided herein. User also agrees to allow ODS to charge the credit card on file for a purchase that does not meet tariff rules. Such payment will be collected without additional notice.

Members provide ODS with their company profile, credit card billing information, delivery address for vouchers and tickets, individuals with their travel preferences and other company and/or personal information. This information is primarily used to assist members in making reservations. Furthermore, when you become a member of any web site owned by ODS you provide your company name, name, address, telephone number, email address, a unique login name, password and password validation. This information is collected on the registration form for several reasons including:
(a) personal identification;
(b) to complete travel reservations;
(c) to allow us to contact you for customer service, if necessary;
(d) to customize the content of our site to meet your specific needs; and
(e) to make product improvements to ODS.

In addition, your email address is collected to send you an email message confirming your new member registration and each reservation you transact online. As a member you may occasionally receive updates from us about fare sales in your area, special offers, new ODS services, and other noteworthy news items. However, you may always decline to receive these email messages.

You, as a customer or a member travel agent, are in complete control of the information you provide to ODS ("Omar's Destination Services") your own travel planning needs or for bookings for your clients. This includes controlling the use of the information you provide to ODS. ODS respects and will continue to respect the privacy of its partners and customers who use this Site.

When you reserve or purchase travel services through ODS, information about you/your customer is provided to the airline, car rental agency, hotel or other involved third party to ensure the successful fulfillment of your/your customers travel arrangements. Occasionally, ODS will hire a third party to act on our behalf for projects such as market research surveys and contest entry processing and will provide information to these third parties specifically for use in connection with these projects. The information we provide to such third parties is protected by a confidentiality agreement and is to be used solely for completing the specific project.

Please be aware that ODS contains links to other web sites that may collect personally identifiable information about you. When you click on one of these links, you are entering another web site for which ODS has no responsibility. Furthermore, this Privacy Policy does not cover the information practices or policies of such web sites. We encourage you to read the privacy policies of all such sites, as their policies may be materially different from ODS's Privacy Policy.

By submitting content to any "public area" of ODS, you grant ODS and its affiliates a royalty-free, perpetual, irrevocable, non-exclusive right (including any moral rights) and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any rights that may exist in such content.

You also warrant that the holder of any rights, including moral rights in such content, has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant the license stated above. TRAVEL RESERVATIONS, TICKETING, PAYMENTS, SHIPPING & CANCELLATIONS

In some cases, certain agreements we have negotiated with third parties such as an airline require us to conceal the service provider and/or other details until after you purchase the service or product. Some fares are special fares that are NONREFUNDABLE, NONTRANSFERABLE AND NON-CHANGEABLE. If you are in any way uncomfortable with the idea that the actual airline/hotel or similar information will only be revealed after you have purchased your service, select a different one. However, if you are interested in substantial savings, you should definitely consider these incredible money-saving fares.

All reservations must be made in the EXACT name of the person traveling - no nicknames. The name on the reservation must be EXACTLY as it appears on the traveler's passport an credit card.

Visas and documents Go To Top
All required documentation for travel is the sole responsibility of the traveler. Each client must have a valid passport to enter Turkey. All persons are responsible for obtaining information about entry requirements and the documentation necessary to enter Turkey and those countries to which they are traveling.

Visa information is based on various publicly available sources and should be used as guidelines only. All the information are not verified as accurate and actual rates may vary.The list is not updated every day. Check the date on the page, if avaiable,r for the day that was last updated. The rates Go To Top
The dollar is the currency used for pricing throughout. All rates on our web-sites are in US Dollars. However due to current regulations in Turkey, the total amount MUST be charged to your credit card in local currency(TL, Turkish Lira), which will be converted later again back to USD by the credit card institute. Therefore silent changes in the total amount shown on your credit card statement is possible.

The following is a list of some major items that not included in the rates when you make a purchase of a any service from the websites of ODS:
Passport and visa fees, inoculations and vaccinotions, any expenses prior to arrival in Turkey, camera fees, airport departure taxes, excess baggage, forwarding of baggage and souvenirs, meals not specified as being included, after dinner tea or coffee, any beverages such as mineral water, soft drinks or liquor, baggage handling, gratuities, minibar and other extra hotel expenditures, room service charges, items not on portions of menus reserved for ODS's passengers, laundry, items of a personal nature and etc.

Payment Go To Top
Payment of the services requested from ODS will be charged on the credit card of the client and the final confirmation is going to be made after the total amount has been charged. ODS accepts MasterCard and VISA credit cards for all purchases. Current billing address, phone information and other information requested must be included with every order.

If you are not the holder of the credit card, in this case the credit card holder, whose name is printed on the card, should send a fax to our credit department at + 90 212 351 29 84, indicating your tracking number for the reservation along with a legible photocopy (front and back) of both his/her credit card and passport, credit card billing address, his/her day and evening phone numbers, and company name and address. A USD 5.- processing fee applies and approval takes one (1) business day. If this documents are not received in 48 hours, ODS keep the right to cancel the reservation and return the amount back to the persons account, whose credit card is used for the transections.

If any service or product is requested per e-mail or fax, you have to complete the credit card authorization form and send it to ODS, after receiving the availabilty confirmation from ODS. In such a case credit cards can only be processed after we have received the credit card authorization form signed by the cardholder. A cardholder cannot pay for another passenger unless the cardholder sends legible signed copies of passport or drivers license with front and back copies of the credit card.

Sales & VAT taxes and tips Go To Top
When you make a reservation through ODS for hotels, tours, blue cruises, guides, and similar travel services;sales and VAT taxes are inluded in the quotation. However, additional taxes, security charges and other fees collected by governments, airports, airlines and other entities are not included unless specifically listed as included features. All taxes will be charged to you, whether it is included in the rates shown on the pages or not. Tips to the guides and drivers are not included.

Shipping Go To Top
By placing an order, the customer accepts the following shipping terms:

All paper tickets must be shipped . All tickets will be shipped via TNT or FedEx Courier Service. This is valid only for the airline tickets, purchased from ODS not from another Web-Site linked from one of our Web-Sites. For the applicable updated rates, please check our related Web Page. The charge will appear on your statement from ODS Reservations.

Travel insurance poicies, all books & cassettes or other purchased products will be shipped via TNT mail service. For the applicable updated rates, please check our related Web Page. The charge will appear on your statement from ODS Reservations.

All tickets and other products purchased from our Web-Sites can only be shipped to the BILLING address of the credit card holder on whose card the ticket was purchased. We are unable to ship to P.O. Box, A.P.O. or F.P.O addresses, and no C.O.D. orders can be accepted. If you wish to have your tickets or products mailed to an address other than the billing address of the credit card or if you are not the holder of the credit card, the credit card holder, whose name is printed on the card, should fax your request to our credit department at + 90 212 351 29 84, along with a legible photocopy (front and back) of both your credit card and passport, your credit card billing address, your day and evening phone numbers, and your company name and address. A USD 5.- processing fee applies and approval takes one (1) business day.

In order to ensure delivery of your tickets or travel insurance policies prior to your departure, we usually cannot accept bookings for travel within 7 business days of departure date.

ODS assumes no responsibility,and shall not be liable for any delay or lost in shipping.

Changes in the reservation Go To Top
All changes after confirmation of the initial program are subject to a nominal fee of minimum $25.- depending upon the time and arrival, number of changes, partly cancellation of services, etc.. This amount does not include the cost of additionally requested services, which are charged additonally.

TOURS
Hotels on the tours Go To Top
All rates are given in per person in Double Room in First Class or best avaible Hotels in the region. Customers could upgrade the accomodation on the tours to Deluxe. It is subject to availablity and supplement. ODS keep the rights to substitute the hotels, if deemed necessary.

Meals Go To Top
Meals, that are included on the tours are stated in each itinary by the code letters.

Transfers Go To Top
The customers will be picked up and dropped off at their hotels. Flight bags should be carried by tour members.

Smoking Go To Top
In general smoking is prohibited on coaches.

Sightseeing Go To Top
Sightseeing as outlined in the itineraries is provided by car, mini- or midibus or motorcoach depending to the size of tyhe group and includes in general the services of English speaking guide. If you prefer any other language, please contact us as early as possible per e-mail or fax. ODS will try to arrange a guide in your own language. If the preffered language requires a supplement, we will inform you in writing ask for confirmation and payment. Again, this is just a serviceof ODS to its clients and ODS never guaranties the availability of the guide in the selected language.

Possible changes in the itinerary Go To Top
Occassionaly, the land portion of your tour may be extented or curtailed because of unforeseen changes in the transportation schedules. There may also be other instances in which changes become necessary or advisable. Any saving realized by these changes will be passed on to the passengers, any resultant expenses shall be borne by the passengers.

ODS reserves the right to refuse any passenger any part of the travel services.

CANCELLATION
Reservations may only be canceled by an e-mail or fax sent to ODS, indicating your username, the tracking number issued for each travel booking

If cancellation is received in writing by ODS prior to arrival in Turkey, a refund could be made minus a administrative charge per person plus the applicable airfare, hotel, tour,etc. cancellation fees, depending to the time untill the check-in or departure date.

Please check each relevant section for general reservation and cancellation policies. If the cancellation policy of the service suppliers differ from ODS, you aggree to accept the cancellation policy of each service supplier.

Some packages are non-refundable. Different cancellation penalties may apply during holiday periods. ODS will not assume responsibility for any changes in travel arrangements made by the passenger after the departure date. All cancellations fees are imposed by hotels and ground suppliers. We advise you to purchase trip cancellation insurance to cover such cancellation fees assessed in the event of serious illness or other situations covered by the policy. You should understand that there are limits and exclusions to the insurance policy.

Reservations for December 30, 2001 through January 1, 2002 are NON REFUNDABLE.

Hotel cancellation Go To Top
If a written cancellation notice is received not later than 21 days before check-in the hotel, ODS will accept cancellation and refund the payment, except for a min. USD 25.00 non-refundable administrative fee.Cancellations made within 21 days are subject to a fee equal to the first night plus tax.

The cancellation policy of the hotel is valid, if it is different than written here. Please read the hotel information carefully. In such cases you will also be informed per e-mail about the special conditions of the selected hotel once your reservation is made.

Tours Cancellation Go To Top
ODS reserves the right to cancel any tour except those bearing the 'guaranteed departure' seal prior to departure for any reason, including insufficient number of participants. If ODS cancels any tour, tour members will receive full refund of monies paid.

If you cancel a tour and the written cancellation notice is received
(1) within more than sixty (60) days before departure, ODS will accept such cancellation and refund to the client after deducting a administrative fee of 10 %of the total amaount.
(2) between 60-31 days prior to departure 50% of the total amount will be refunded.
(3) between 30 - 16 days 20% of the total amount will be refunded to the client.
(4) less than 15 days prior to departure, there is no refund.

If any person is removed from the trip by the operating company of that particular tour (or any optional side trip), ODS's only obligation shall be to refund to such a person a fraction of the trip price, ( in accordance with the operating tour company's approval ) the numerator of which fraction shall be ODS cost for the person's unused services and the denominator of which shall be ODS cost for the person's entire trip.

Blue Cruise Cancellation Go To Top
If you cancel a tour and the written cancellation notice is received
1 ) within thirty (30) days before departure, ODS will accept such cancellation and refund to the client after deducting a administrative fee of 10 %of the total amount.
2 ) If a written cancellation notice is received thirty - sixteen (30-16) days prior to departure, % 65 of the payment will be refunded.
3 ) If a written cancellation notice is received fifteen (15) days or less prior to departure, no refund will be made .

Tourist Guides Cancellation Go To Top
If a written cancellation notice is received

The responsibility of ODS is strictly limited. As a tour operator, ODS organizes, promotes and sells tour programs consisting of certain travel services, including, but not limited to, surface transportation,sightseeing excursions and hotel accomodations which ODS purchases or reserves from various suppliers. The suppliers providing travel services for ODS programmes are independent contractors and are not agents or employees of ODS or any subsidiary company. For all other purposes, ODS does not act as an agent for any party whatsoever. ODS is not responsible for the willful or negligent acts and / or omissions of such suppliers or of any air carrier or their respective employees, agents, servants or representatives including, without limitation their failure to deliver or their partial or inadequate delivery of services. All coupons, receipts and tickets are issued subject to the term and conditions specified by the suppliers and / or carriers. By utilizing the travel services of the suppliers, you aggree that neither ODS nor any subsidiary company or representative shall be lasle for any accident, injury, property damage or personal loss to you or to those travelling with you in connection with any accomodations, transportation or other travel services or resulting directly or indirectly from any occurances or conditions beyond its control, including, but not limited to, acts of terrorism, defeckts in vechiles, break,down equipment, strikes, theft, delay or cancellation of or changes in itinerary or schedules.

ODS shall not be liable or responsible in any way whatsoever for any inconvenience, loss, damage or injury arising out of or in connection with such tour services, whether same shall be the result of changes in hotel accommodations, food, baggage handling, tour guiding or any other matter related there to. All such losses or expenses will have to be borne by the passengers. Each passenger waives any claim against ODS for any delay, inconvenience or damage, loss of property or baggage or injury to or deaths of persons due to the acts or omissions of said third parties. Any airline / transportation company concerned is not to be held responsible for any act, omission or event during the time passengers are not aboard their aircraft or conveyances.

All the programs and services within this web site are planned in advance. If between planning time and the actual operation, circumstances beyond ODS's control require changes, ODS reserves the right to vary itinerary and substitute components of tour programmes. ODS further reserves the right at any time to change any part of the itinerary, or the carrier, or the aircraft utilized, or the hotel accommodations utilized, or boat charter, or any other. The prices advertised are subject to change without prior notice. In such case each passenger can be required to pay an additional amount for the trip reflecting such increase.

The payment of the required deposit or any partial or full payment for a reservation on a tour constitutes consent to all provisions of the conditions and general information contained in this website. The terms under which you agree to take these tours cannot be changed or amended except in writing, signed by an authorized officer or agent of ODS or its subsidiary companies.

Remember that all travel documents, as well as compliance with customs regulations, are your responsibility. Each person is also personally responsible for any hotel expenses, theater tickets, souvenirs, gifts, clothing, glasswork, art or any and all other items of personal property or services purchased by such person.

ODS assumes no responsibility,and shall not be liable for any delay or lost in shipping.

ODS assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing in this site or your downloading of any materials, data, text, images, video or audio from the site. This limitation of liability shall apply regardless of whether the claim asserted is based on contract, negligence, or any other theory of recovery.

This Agreement and its performance shall be governed by and construed in accordance with the laws of the Republic Turkey, without regard to its conflict of law provisions. You consent and submit to the exclusive jurisdiction and venue of the courts located in Istanbul, Turkey, in all questions and controversies arising out of your use of this site and this Agreement. If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

ODS provides no insurance for its clients due to loss. Clients are advised to obtain their own insurance for health while traveling and / or baggage loss. Insurance is also recommended to provide coverage to clients if refunds pursuant to the final payment and cancellation clause below are unavailable due to the terms of that clause.

It is your responsibility to read the terms & conditions of "Assist-Card", which is offered on this site. The "Assist-Card" is provided to you from Assist-Card Turkey. ODS assumes no responsibility, and shall not be liable for the services of Assist-Card. Please contact Assit-Card Turkey, if you need assistance during your stay in Turkey.
